"Individual Mandate Survives as a tax"
ACA upheld...
Just more fuel to clean house (the White House) in November to make sure total repeal is enacted. And a Constitutional amendment is needed to close this "taxing power" loophole.
Lovely. Roberts folds under the pressure of being labeled an "activist" judge. Good appointment, GWB.
The world just got a little bit dimmer.....
Relieved that they didn't find this was okay under the commerce clause.

Historically, Republican presidents have done an abismal job of selecting Supreme Court justices, particularly Chief Justices. Look at this history:
Chief Justice Warren= Eisenhower
Chief Justice Burger= Nixon
Chief Justice Roberts= G.W. Bush

Don't underestimate the SCOTUS. It is interesting that Roberts joined the majority to bend over backwards to construe the enforcement mechanism of the mandate as a tax instead of a penalty. The enforcement mechanism reads more like a penalty than a tax, the Administration sold it as a regulation and not a tax, and the chief argument was that it had the individual mandate was a regulation that was supported under the Commerce Clause and Necessary and Proper Clause.
Does the decision give the Republicans more ammo for 2012 election? I think so. Perhaps Roberts was being shrewd and realized that he no basis to undo the ACA judicially, but this decision gave the GOP a chance to dismantle the entire ACA legislatively after 2012.
WHat if the states would have gotten their way and the mandate was found unconstitutional? There was no support for finding the whole law unconstitutional - that was a nonstarter. That would have been a real disaster. The insurance risk pool would have gotten much sicker (due to coverage for people with preexisting conditions that were previously denied) and thus gotten more expensive. This would result in more healthy people bailing out, making it even more expensive. An insurance death spiral.

A lot of folks are happy that ObamaCare has passed a key Constituional review.
Not sure what November will bring but I don't see the republicons winning the Senate.
