    Man Charged with First Degree Murder for inducing Girlfriends Miscarriage

    While I am pro-life, I do not see how this man can be charged with 1st degree murder. If a fetus is not really a person, and a woman can have an abortion at this same stage and not be charged, then how can it be a person for the boyfriend and not a person if it were the female?

    Based upon what I have found, women can have abortions in Kansas. New laws took effect July 1, 2014, which talk about a 24 hour waiting period, among other things prior to having the procedure carried out.

    Yeah, abortions are legal everywhere for the first trimester and states can regulate second trimester within certain parameters. That is the effect of Roe v. Wade. But that case was really more of a balancing act than anything - not explicitly stating that a fetus is not a person. More that the mothers right to privacy outweighed (implicitly finding the fetus not a person in the first trimester).

    States are more likely to be able to pass laws against someone other than the mother causing the unlawful death of the fetus (protecting a mother's right to reproduce). Even without such laws, this would be aggravated assault against the mother.

    But if this guy gets convicted of first degree murder, I bet the conviction gets overturned. Kansas does not exactly have a strong history of respecting the Constitution.

    I hope it sticks. If someone had done this to me they would have been charging me- he would already be dead.
