Gun rights amendment helping felons charged with illegal gun possession
Around midnight last Aug. 24, police say a convicted felon named Rickey Jackson stood in the intersection outside a Magnolia Street nightclub, holding a broken, rusty gun in his right hand.

Jackson, convicted a decade earlier of possession with intent to distribute cocaine, was booked that night with being a felon in possession of a firearm, a charge that carries a term of 10 to 20 years in prison without parole.

But whether that charge will stick is now uncertain -- an Orleans Parish judge recently ruled that it violated the state Constitution.

Three months after Jackson's arrest, Louisiana voters passed, by a sweeping majority, a constitutional amendment that declared that the "right to keep and bear arms is a fundamental right." It gave gun ownership the same level of judicial protection as free speech or racial equality, requiring that the highest level of scrutiny be applied to any law that might restrict the right to own a weapon.

In the weeks leading up to the election, Gov. Bobby Jindal wrote an op-ed column reminding readers of looting in the aftermath of Hurricane Katrina and endorsing the amendment as a necessary safeguard against dwindling federal gun rights. Jindal described it as "an ironclad guarantee of freedom here in Louisiana."

    Re: Will Smith

Statboy this is for you. I am a huge Saints fan and Will Smith fan. I'm shocked and devastated for his wife family and friends! Prayers to all.

Will Smith was a good family man, player and citizen of New Orleans. How very sad!! Sicko people kill other people....... not their guns.

Ex (Dem)President Bill Clinton was actually right this week when he chastised Black Lives Matter protestors saying, “I don’t know how you would characterize the gang leaders who got 13-year-old kids hopped up on crack and sent them out on the street to murder other African-American children,” Clinton said, pointing his finger at the crowd. “Maybe you thought they were good citizens.”“You are defending the people who killed the lives you say matter!” he went on. “Tell the truth. You are defending the people who caused young people to go out and take guns.”

Another senseless black on black murder (this time prominent) that Jessie Jackson, Obama, Hillary and Rev. Sharpton will say nothing about in public.

Never let a crisis...or a bold font go to waste I see.

The thug that shot Will Smith had already been arrested for illegal possession of a firearm...apparently the laws weren't real high on his priority list.

The only thing that would've stopped him would've been a good guy with a gun. Refuse to believe that if you want. Continue to believe that there's some magical law that can be passed that will make 300 million firearms disappear. Pretend that you can legislate violence out of existence...but go do that on another thread.

Never let fundamental reading go to waste. If you had taken the time to actually read and comprehend the article. You would have seen that the new law actually made it easier for felons to legally carry guns.

I really don't give a rats ass what Bill Clinton had to say to BLM or anyone else. It takes a pretty simple minded SOB not to understand the difference between people murdering unarmed citizens. Who are paid to protect and serve and getting away with it. Versus some idiot shooting up a car and being rightfully arrested, charged and convicted.

Typical childish reponse when someone can't make a complete coherent sentence to refute a simple fact. Lie on the person you're assaulting.

I'm for a minimum 20 year prison sentence for anyone that commits a crime regarding a firearm. If you use false information to purchase a firearm ...20 yrs....if you steal a firearm 20 yrs...if you shoot at highway signs or cars...20 yrs. Getting tough with theses criminals would put an end to a lot of theses crimes.
