    As the attacks on the Electoral College continue, we can see how important the Electoral College is from the 2016 presidential election results. Many observers have noted that Clinton's margin in California was greater than her plurality nationwide. Many observers have also argued that without the Electoral College, a couple or a few large states would dominate elections. What few if any have noticed is that in 2016, the Electoral College prevented 3 out of 3,141 counties with about 5% of the electorate and population from picking the president.

    I fell like his logic breaks down at a couple of places.

    But I guess he's trying to address the criticism of states "picking" the president, by choosing a different grouping, specifically counties as the grouping. But I think the argument for a popular vote instead of the electoral college is that individual humans should be the base level of the decision making process (as opposed to the states).

    He also seems to be saying "take away the three biggest counties that voted for Clinton and she wouldn't have won the popular vote." Well, sure. Take away those last 2.8 million votes from wherever you want. Take away 3 million votes from Trump in the right cherry picked places and he doesn't win the election (and loses the popular vote by twice as much of course).

    I mean, it doesn't have to be 2.8 million. In a one vote popular victory - any of the winning voters "decided" the election. Or "picked" the president.

    I'm just not sure this holds up. You could maybe make a case for the electoral college, but I'm not sure this is it.

    Interesting analysis on FOX...

    Biden 260 Trump 258

    every state accounted for except Pennsylvania with 20 EC votes. IF Trump out-performs the polls by the exact same margin he did in 2016 he comes up 1% point short, and Biden wins the WH. So, he has to do even better this time around.

    And of course, all of this is based on all the other states breaking the way they did in 2016... in regards to Trump vs. the polls. Big assumption. But, it is interesting and does indicate it will be a close race.

    I saw an analysis by 528 or 538 or whatever that had Texas and Florida blue for Trump.. No idea what this guy is smoking but neither of those are going to happen.

    i don't recall crenshaw ever being a big trump cheerleader. he has defended trump against stupid criticism, but that's about it. did he mention trump in his 2018 campaign?

    i have mentioned on multiple occasions why i can't bring myself to vote for trump, but there are a lot of reasons no one should ever vote for biden -- especially if they don't like trump.
    1) biden is a career politician who is undeniably corrupt.
    2) biden appears to be guilty of at least some form of sexual assault in the past, and is creepy af still.
    3) biden was part of an administration that used drones to assassinate american citizens.
    4) biden was part of an administration that used it's bureaucracy to make things difficult for their political opponents.
    5) biden was part of an administration that is guilty of (at minimum) negligent homicide in benghazi, and covered it up with a ridiculous story.
    6) biden is part of a party that has no problem demonizing trump for policies that started under his administration.
    7) biden seems to be at least a little bit racist.
    8) biden will undoubtedly appoint judges that are willing to invent new meanings for old laws when convenient.
    9) biden will very likely stack the supreme court with such judges if he can.
    10) biden wants to implement tax plans that will disincentivize investment, which will likely lead to millions more people dropping into poverty.
    11) biden is every bit as egotistical and hotheaded as trump -- brags about his iq, plagiarizes speeches, and loses his temper when challenged by anyone with less power than him.

    on top of all of the above, the "mainstream media" and "big tech" companies are willing to cover for him, which makes him much more dangerous than trump.

    the only reason i can think of to vote for biden would be to send a message to the republican party, but i think that one reason is far outweighed by the reasons above. this is why can't vote for biden.

    Bob, I disagree with most of your opinions here except for maybe your point about the courts, but even that is a loaded idea. It is really hard to come up with a compelling reason why “originalism” should be a value in itself, particularly if you are willing to apply originalism to overturn precedent, given that predictability under the law is so important for business and individuals to know what their rights actually are. “Originalism”
    isn’t even a pure concept, because self-labeled originalists are more than happy to not apply original meanings where it doesn’t suit their purpose. In effect, “originalism” just becomes code that we will remain dug in a few key Republican issues - not taking expansive views of the constitution to recognize rights where they haven’t been before.

    But the real issue I take is with your view that Biden’s plan disincentivize investment. Capital gains taxes don’t do that. One reason is there just isn’t an alternative to wealth creation. If anything, you could argue it disincentivizes capital gains realization, causing folks to maintain their investments longer. But that is typically a transient thing and comes out in the wash.

    What discourages capital investment is uncertainty, and Trump has created a lot of that, particularly around where to run your supply chains.
