    The NCAA can kick them out. Think those three schools in California have enough leverage to lead other states to go against the NCAA? I don't. Florida and their big 3? Nah. Texas, Alabama, and Michigan are also a no. Oregon and Washington are a maybe

    That doesn’t make it not stupid. It needs change. The NCAA shouldn’t keep them from succeeding off the field, because the reality is most will not have a future on the field. Athletics should be an opportunity. Owning their own business or playing video games for extra money on YouTube doesn’t make their athletic standing professional.

    I don't think Title IX is a concern. The volleyball team or softball team can go shill for Honest's Joe's Quality Motercars, too.

    I think the best part of this that y'all who are opposed are overlooking is the unintentional comedy gold opportunity. Can't you see the starting offensive line doing an add for the local buffet? Or some poor country kid that can barely read trying to do an ad for Mercedes of Knoxville? The possibilities are endless.

    Any state that followed California would be insane. They have proven they can't do anything right so far. This will be a debacle as well.

    I don't know. They seem to have figured out the weather. I wish states I've lived in would follow them in that.

    I believe the inventor should always have ownership, though that is not always the case. But again, who is harmed by the engineering student's ownership? No one. He/she is not competing with amateurs who are at a disadvantage.

    However, college football is different. The "owner" is literally competing with other "amateur" athletes who may not have access to the same resources, or the same number of "high-paid team-mates". That automatically creates an unfair advantage (or a competitive imbalance) for the team being paid.

    Correct me if I’m wrong, but I think the university retains ownership of a students invention if it was created with university equipment.

    I do not know about student/university relationship but in business, if there is no contract assigning patents the employee/inventor owns the invention. The employer retains a "shop right" which is hard to define for larger corporations. But that's the theory. Generally larger corporations will require engineers and others likely to invent things sign a general assignment of all inventions and this usually includes any made in off time. Sometimes the assignments are limited to subject matter related to the employer's business.

    That is true of intellectual property as well. If a professor writes a paper (article) that is a "How to..." and used a university computer then it belongs to the school. MOST of the time professors do not create a concept, a new idea that has any value in the real world, thus cannot be monetized and therefore no one, including the university, cares. And! universities require their professors to publish as a condition of employment/to garner merit increases, to maintain accreditation, and want professors writing/publishing/researching. BUT if something ever strikes a cord and takes on monetary value, it belongs to the school. UNLESS!!! the professor can prove he/she never used any university equipment, did not write even one sentence on "university time," and never used any university asset and did not require students participate as part of credit for a course.

    Many professors who fancy some post-teaching career as a consultant buy their own "everything." Have personal laptops and also own personal services such as survey and research subscriptions. If the university paid those fees any data gathered would belong to the school, not the professor.

    Sorry...I know a Dean who has to constantly monitor all this kind of stuff for her faculty.
