I think when faced by a local jury, this guy probably loses. However I think any conviction would be overturned by any appeal in another venue.
Could happen Ryan, but If they do win on appeal then the "Louisiana Law" will be what gets appealed. Did you read the early article that explained how the law works and applies to different communities? Very strange law IMO, but no doubt the store is unlawful in Lincoln Parish and probably is in every Parish in North Louisiana except Caddo/Bossier and maybe some of the Miss. River Parishes.
Yeah, I called myself reading it closely, but not being a lawyer, it is kind of hard to pin down the ramifications of "contemporary community standards". Yes, in general Ruston is a very conservative town but since the property is in the Parish and not in the city, and the immediate community surrounding it consists of a mexican restaraunt, a nightclub/restaraunt, a full blown liquor store and a couple of drive-through daquiri shops, who's to say what the contemporary community standards are?
But I do think these guys get lit up by a jury trial in Lincoln parish and they are ultimately going to be the ones who interpret the law.

And I think the purveyors of the (probable) filth on I20 should be run out of town, but by the capitalist system not the DA. Since I haven't visited this store I don't know what they sell but it's probably similar to the right wing bs on Fox "News". No upstanding, moral, person would buy that crap. ; )
Probably the best chance of running these guys out of town lies in a civil suit brought about by cactus jack's for painting the ttc that godawful pink color and driving their business away.
