Yeah they could, just like they can fire you for being drunk currently.
Jordan Mills on choosing Tech:
“It’s a great experience seeing them play. It was a good atmosphere. The fans stood up the whole game and never sat down. They have a great fan base.”
You CAN be fired for drinking on your own time unless your employment is not at-will.

If your employment was at will you would just be fired...they would not specify that you were fired for drinking... that would be dumb on the employers part to specify that you were fired for drinking... you can only be fired for drinking if it is in your employment contract....

"Some legal scholars and policy analysts say the government will not be able to require California to help in enforcing the federal marijuana ban if the state legalizes the drug. Without assistance from the state's legions of narcotics officers, they say, federal agents could do little to curb marijuana in California."
"Even though a federal ban is still in place and the federal government can enforce it, it doesn't mean the states have to follow suit," said Robert Mikos, a Vanderbilt University law professor who recently published a paper about the issue."
The DEA will be raiding the crap outta that state though.
Wrong, wrong, and wrong!
You damned well better put the precise reason you let someone go, even if it is at-will employment. At-will doesn't mean they won't sue or visit the EEOC!
Most people don't have an employment agreement, but if an employer has a reasonable policy pertaining to drinking...and you violate the policy...you will be fired! Just did it last week!
I'm an asshole! What's your excuse?
