I'm not a lawyer. I'm only a guy with an opinion. Does the trademark disallow vendors from selling shirts with the phrase "Who Dat?" Or does the trademark disallow vendors from printing up shirts in an attempt to profit from someone else's work? JMHO, but that's where the line should be drawn.
The NFL is claiming they own the rights to the term "Who Dat"? Their gripe is that it is being printed on a black and gold t-shirt with a fleur de lis, giving the impression that the shirt is an NFL licensed product.
So technically they are saying that nobody can sell a t-shirt with "Who Dat" on it except for NFL licensed vendors.
That's not what the NFL says in it's court filing. They are saying they have "exclusive rights" to the phrase Who Dat. You are right that they only want NFL licensed vendors to be able to sell it (so the NFL can get their cut) and I completely support that when it involves the teams name or marks. However, it's going to be tough to prove because the term Who Dat was in use before the Saints used it, and the fleur de lis has been a symbol of New Orleans since the French and Spanish brought it over to the new world. Maybe Goodell controls the new world as well.
Another fly in the ointment is the fact that Bobby Jindal signed a bill in 2008 making the fleur de lis an offiical state symbol here's the link . So, why can't mom and pop sell a tshirt which bears words that have been around for more than a century and an official state logo?

If the NFL legal beagles had balls, they'd file their lawsuit in Louisiana. There is no way a Louisiana judge would rule in the NFL's favor.
So, instead, they go to Florida and use some hanging chad for balls.

These small merchants, entreprenuers of New Orleans, and the surrounding area, have more right to do whatever they want to benefit from Saints' mania than the F'ing NFL.
