I'm not sure it would be protected, nor do I think it should be.
I will be the first to say that I do not believe video games influence "real life" actions, but this is just absurd. Sexually molesting and harassing a young female in the name of "art" or "free speech" is totally insane.
What law on the books would prohibit it? Child porno?
I wouldn't approve of my kid playing that game. I don't want to make that decision for everyone though.
An interesting article about the 'delay' in covering this story by CNN:

Abuse of freedom always comes, leads to legalism. Main problem with freedom, people cant use common sense enough.
Most of this type of "hentai" would probably not be protected speech in the United States.
Funny how "obscenity" is not protected, which arguably does not harm anyone directly, whereas this stuff is protected:

Jordan Mills on choosing Tech:
“It’s a great experience seeing them play. It was a good atmosphere. The fans stood up the whole game and never sat down. They have a great fan base.”
GTA is pretty much just as bad... In the game you can pay a "lady of the night" for services and then bash her brains in and get your money back...
What kind of lowlife do you have to be to protest at the funeral of an American soldier. A lot of these churches with free tax exemptions are nothing but cults attended by a bunch of loons. By the way, Bill O'reily is paying Mr. Snyder's legal fees. That's the same Bill O'Reiley that some of you on here compared to Barack Obama.
