    Re: Covid - 19

Looks like the Supreme Court shot down Cuomo's exec order as unconstitutional.. targeting religious services.. A win for the constitution and religious freedom..

The U.S. Supreme Court has temporarily barred New York from enforcing strict attendance limits on places of worship in areas designated coronavirus hot spots, in a decision released late Wednesday.
The court ruled that Gov. Andrew Cuomo's executive order violated the First Amendment's "free exercise" clause, and actively discriminated against religious institutions.
"The restrictions at issue here, by effectively barring many from attending religious services, strike at the very heart of the First Amendment's guarantee of religious liberty," the unsigned majority decision read.
The 5-4 decision, with Chief Justice John Roberts Jr. and Justices Stephen Breyer, Sonia Sotomayor, and Elena Kagan dissenting, comes as confirmed cases of coronavirus surge around the country.
Notably, the court's ruling is in contrast to two decisions it issued in May and June concerning churches in California and Nevada, which allowed state officials to restrict attendance at religious services. Those decisions came before Justice Amy Coney Barrett joined the bench, giving the Supreme Court a conservative majority.
However, California and Nevada had far less severe restrictions compared to New York, the justices explained in Wednesday's order. The California church limited attendance to 100 people. In buildings with a capacity of 400 or fewer people, capacity was limited to 25%. In Nevada, churches were limited to 50.

FOX News reported Governor Coma withdrew his EO knowing the SC was going to strike it down. Regardless of the details, it is a victory for goodness.

    And another defeat of originalism!

Unless Cuomo is now part of Congress...

    1st Amendment:
“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;”

It was reported Coma knew his edict, his EO, stood no chance in the SC. I suppose for the very reason you posted. I was merely saying FOX reported it was withdrawn, therefore the SC did not actually rule on it. We're splitting hairs here...Gov. Coma's illegal EO is done. That's the bigger point.

So are you supporting Cuomo or SCOTUS on this one?

You think it is illegal because you are no longer an originalist?

Turns out, according to other sources, the SC did rule on it. 5-4 final vote. Guess that RINO Roberts was part of the 4. Yep, he was...finished reading the article. He's a POS, but he was nominated by GWB...another RINO, so guess that's to be expected.

Both were true, they happened simultaneously and separately. Coma did withdraw that portion of his EO he knew the SC would strike down, but the order had already reached the SC in its original form. Minor details, I know, but in the interest of the facts, thought I would post this clarification.

My wife just lost two second cousins to the China virus. They were a husband/wife, both in their 70's and both had pre-existing conditions. Willard had diabetes, the full-blown worst case kind, and Gail had heart problems...had had stints put in. They had just sold their house and purchased a condo in a gated community for "older" folks. Two weeks ago they were just fine...last night both passed within a couple of hours of each other. They were actually holding hands when Willard passed.

On what basis did you find the EO illegal? If it is the first amendment, it only says “Congress shall pass no law...” and Cuomo ain’t Congress. Thus, it would seem that you have to be open to the idea of Courts legislating from the bench and rewriting the Constitution to make such an EO illegal.

No, I see it as the SC protecting people's 1st Amendment rights. Since this was aimed directly at religious rights you, as an atheist, giddily cheered Coma on.

But, what if a governor issued an EO that says, "No channel in this state can broadcast CNN and MSNBC. And, copies of the NY Times and the Washington Post are hereby banned. Furthermore, no one is allowed to speak fondly of any left-leaning politician either in person or via social media."

That would be okay, right, since that governor is not Congress, and you would support that governor's edict, right?
